These Terms of Service ("Terms") govern your use of the Augustapp application (the "App") operated by BeAugust LLC ("BeAugust", "we", "us", or "our"). By using our App or authorizing it to access your Meta platform accounts, you agree to these Terms.

1. Description of Service

BeAugust provides a social media management platform that enables businesses and their authorized representatives to manage social media accounts, advertising campaigns, messaging, and analytics across Meta platforms (Facebook, Instagram, Messenger, WhatsApp, and Threads) through Meta's official APIs.

2. Account Authorization

By connecting your Meta accounts to our App, you authorize BeAugust to access and manage your accounts in accordance with the permissions you grant. You represent that you have the authority to grant such access and that your use complies with Meta's terms and policies.

3. Acceptable Use

You agree to use our App only for lawful purposes and in compliance with all applicable laws, regulations, and Meta's platform policies. You shall not:

• Use the App to violate any third party's rights, including intellectual property rights.
• Distribute spam, malware, or any harmful content through our services.
• Attempt to gain unauthorized access to other accounts or systems.
• Use the App in any manner that could damage, disable, or impair our services.

4. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in our Privacy Policy.

5. Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is the property of BeAugust and is protected by intellectual property laws. You retain ownership of all content you create or provide through the App.

6. Third-Party Platforms

Our App integrates with Meta platforms and is subject to Meta's terms and policies. We are not responsible for changes to Meta's APIs, policies, or platform availability that may affect our services. Your use of Meta's platforms is governed by Meta's own terms of service.

7. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the App at any time with reasonable notice to affected users.

8. Limitation of Liability

To the maximum extent permitted by law, BeAugust shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for our services in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold BeAugust harmless from any claims, losses, or damages arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.

10. Termination

Either party may terminate the use of the App at any time. Upon termination, we will revoke access to connected accounts and delete associated data in accordance with our Privacy Policy and data retention practices.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
